The Terms and conditions are deemed to have been accepted on the submission of the Client Registration Form. The agreed terms are non negotiable and are accepted on submission of the registration form. The agency acts only as an introduction and booking agent and does not directly or indirectly employ staff. Staff are always employed by the client.

All invoices must be paid prior to commencement of any employment.

All information and introductions supplied by the Agency are Confidential. Any passing of any information to potential clients, applicants, employees, other agencies or current employers is strictly forbidden and is liable to the full fee being charged to the Client. This will also constitute a breach of contract and will be subject to damages being paid by the Client to the Agency in addition to the full fee.

The Client agrees to notify the Agency immediately an engagement has been accepted by an applicant and to supply details to the Agency of the date of commencement and length of employment (when appropriate) and agreed wages (when appropriate).

Should an engagement be extended by the Client, or any applicant be re-engaged within 12 months from the date of leaving, the appropriate additional fee shall become payable, in accordance with the current Scale of Charges. The Agency must be notified immediately of any such changes.

In the event that an applicant introduced by the Agency is dismissed by the Client and leaves within 4 weeks of engagement, or if the applicant leaves of his/her own accord within that period, the Agency must be notified in writing within seven working days of the termination of the engagement and the initial invoice was paid in accordance with this agreement.

If the applicant does not remain in the client's employment for a minimum of 4 weeks the agency may offer to replace the applicant free of charge.

The Agency will not provide a replacement where the Applicant had been treated unreasonably by the Client, given the circumstances of the job they are being retained to do or where the Client requires the Applicant to do duties that were not agreed at interview or are contained in any contract between the Client and Applicant.

The Agency cannot guarantee that an applicant will complete his or her proposed length of stay or engagement.

The Agency cannot be held responsible for the Employees contract of employment, National Insurance or Tax deductions. These must be arranged between the client and employee. Please note that not declaring to be an employer to avoid tax is a criminal offence which can result in heavy penalties and damaging publicity. It also affects future pension and benefits entitlements of your employee under the National Insurance scheme.

The Agency shall not be liable under any circumstances for any loss, expense, damage, delay, costs or compensation (whether direct, indirect or consequential) which may be suffered or incurred by the Client arising from or in any way connected with the Agency seeking an Applicant for the Client or from the Introduction to or Engagement of any Applicant by the Client or from the failure of the Agency to introduce any Applicant.

The Client is responsible for the prospective employee’s reasonable travelling expenses for the purpose of interview and this is to be settled directly with the individual.

These terms and conditions relate only to the Introduction by the Agency and in no way whatsoever form the part of any contract between the Client and employee, this is at the sole responsibility of the Client.

In the event that after an engagement is offered and is cancelled by the client prior to the start up of the position, a Ł200 fee is Chargeable to the Client by the Agency, in consideration of administration costs incurred by the Agency.

The Agency’s fee is applicable to one engagement and the fee for any applicant returning at a future date will be charged to the client at the usual rates. Should any engagement or re-engagement occur without notification to the Agency by the client, the full permanent will be charged to the client irrespective of the length of employment.

All reasonable and due care is taken by the Agency to screen Applicants but no guarantees whatsoever are given by the Agency with respect to the Applicant’s suitability or otherwise, save that the Agency will always check the qualifications of the applicant and their references to satisfy itself that the applicant is suitable, although the Agency cannot be responsible for the bona fides or accuracy of the said references.

The agreed introduction fees shall be paid by the Client to the Agency within 7 days of the date of issue of the invoice. Interest will be chargeable on all outstanding invoices at the rate of 5% above the prevailing base rate of Barclays Bank PLC from the due date to the date of actual settlement.

In the event of the Client not paying the Agency fee, the Agency reserves the right to remove their applicant from that employment, without notice to the Client.

The Agency fees are non refundable.
We reserve the right to amend these terms and conditions without prior notice. The Agency reserves the right to decline any registration without explanation.
